These General Terms & Conditions (“GTC”) apply to all orders placed through the website www.basketful.ch
and to all business relationships between Basketful (“we”, “us”, “our”) and the customer (“you”, “your”).

By placing an order on our website, you confirm that you have read, understood, and accepted these GTC.

3. Products and Gift Basket Contents

3.1 Basketful offers curated, premium gift baskets and gift boxes for various occasions. Each basket is carefully assembled using products sourced from Swiss and international third-party suppliers.

3.2 Certain products or materials may be imported and may vary in origin, packaging, appearance, or manufacturing standards.

3.3 Product descriptions, images, and dimensions are provided as accurately as possible. Minor variations in color, packaging, presentation, or design may occur.

3.4 If a product becomes unavailable, we reserve the right to replace it with a similar item of equal or higher value, while maintaining the overall quality and character of the gift basket.

4. Prices and Payment

4.1 All prices are stated in Swiss Francs (CHF) and include VAT where applicable.

4.2 Delivery or shipping charges are shown separately during checkout before payment is completed.

4.3 We accept the payment methods displayed at checkout, which may include credit card, TWINT, PayPal, or invoice if offered.

4.4 Payment is due immediately upon placing the order, unless otherwise explicitly agreed.

5. Delivery, Shipping & Pickup

5.1 Delivery Area

We currently deliver within the main German-speaking regions of Switzerland, including areas in and around Zurich, Zug, Winterthur, St. Gallen, Buchs (SG), and Canton Schwyz.

5.2 Delivery Options & Charges

Local delivery (Siebnen, Lachen, Pfäffikon, Reichenburg): Free

Canton Zurich, Zug, and Liechtenstein: Flat rate CHF 50

Canton St. Gallen: Flat rate CHF 80

Free delivery for orders over CHF 200, regardless of distance within these regions

5.3 Local Pickup (Self-Collection)

Customers may collect their order free of charge by appointment only at our location in 8854 Siebnen, Canton Schwyz.

5.4 Processing & Delivery Times

Order processing time: 1–3 business days

Estimated shipping time: 3–14 business days

Delivery times shown on the product page and order confirmation are estimates and include processing and transit time.

Once shipped, customers will receive a shipping confirmation and tracking number where available.

Actual delivery dates may be affected by external factors such as courier delays, weather conditions, or logistical constraints. The tracking information provided by the courier is considered the most up-to-date reference.

5.5 Transfer of Risk

Once the order has been handed over to the courier, the risk of loss or damage passes to the customer, subject to mandatory consumer protection laws.

6. Alcoholic Products

6.1 Some gift baskets may contain alcoholic beverages.

6.2 By placing an order containing alcohol, you confirm that you meet the minimum legal age requirements under Swiss law:

- At least 16 years old for wine and beer

- At least 18 years old for spirits

6.3 We reserve the right to request age verification before delivery.

7. Imported Goods

7.1 Some products, accessories, or materials may originate from international suppliers.

7.2 Imported goods may differ from Swiss-made products in terms of production standards, labeling, or packaging.

7.3 We are not responsible for manufacturing defects originating from third-party suppliers. However, we will assist customers in resolving issues where possible.

7.4 Any customs clearance for imported materials is handled by us. No additional customs charges apply to customers.

8. Returns, Refunds & Defects

8.1 All Basketful gift baskets are custom-made and therefore not eligible for return, except in cases of damage or clear defects.

8.2 If your order arrives damaged or incorrect, you must notify us within 48 hours of delivery and provide photos of the damaged items and packaging.

8.3 If a claim is accepted, we may offer one of the following at our discretion:
- Replacement
- Partial refund
- Store credit

8.4 Perishable goods (including food, chocolate, or fresh items) are non-returnable.

9. Allergies & Food Safety

9.1 Customers are responsible for reviewing ingredient lists and allergen information before consumption.

9.2 We rely on information provided by manufacturers and suppliers and do not independently verify allergen content.

10. Custom Orders

10.1 Custom gift baskets may require additional preparation time.

10.2 Full payment is required before production of custom orders begins, unless agreed otherwise in writing.

10.3 Once confirmed, custom orders cannot be cancelled or modified.

11. Liability

11.1 Basketful is not liable for:

- Delivery delays caused by courier services
- Defects caused by third-party manufacturers
- Allergic reactions or misuse of products
- Damage caused by improper storage after delivery

11.2 Our liability is limited to the purchase price of the affected product or gift basket, to the extent permitted by Swiss law.

12. Intellectual Property & Content Usage Rights

All images, designs, text, graphics, and other content on this website are the property of Basketful or licensed for use and are protected under Swiss intellectual property laws.

Any reproduction, distribution, modification, or use of website content without prior written consent is strictly prohibited for both commercial and non-commercial purposes and may result in civil or criminal liability.

13. Data Protection

13.1 Personal data is processed in accordance with the Swiss Federal Act on Data Protection (revDSG).

13.2 Data is used solely for order processing, customer support, and website functionality.

13.3 We do not sell or share personal data with third parties except where legally required or necessary to fulfill an order.

14. Applicable Law & Jurisdiction

These GTC are governed exclusively by Swiss law.

The place of jurisdiction is 8854 Siebnen, Canton of Schwyz, unless mandatory consumer protection regulations provide otherwise.

15. Changes to These Terms

We reserve the right to amend these General Terms & Conditions at any time. The version published on the website at the time the order is placed shall apply.
